Flower Hero Terms of Service

These Terms of Service (“Terms”) govern your use of the Flower Hero website and your purchase of products or services from Flower Hero (“Flower Hero,” “we,” “our,” or “us”). By using our website, submitting an order, or enrolling in a subscription, you agree to these Terms and our Privacy Policy.

Orders and Payment

You must provide complete, current, and accurate billing, contact, recipient, and delivery information. Prices, delivery charges, taxes, promotions, and availability may change without notice. The total amount displayed at checkout or confirmed by Flower Hero is the amount you authorize us or our payment processor to charge.

Submitting an order does not guarantee acceptance. We may decline or cancel an order because of product availability, incorrect pricing, suspected fraud, delivery limitations, unsafe conditions, or other reasonable business concerns. If we cancel a paid order, we will issue an appropriate refund.

Floral Designs and Substitutions

Flowers are natural, seasonal, and individually unique. Photographs represent the intended style, size, color palette, and overall value but do not guarantee an exact arrangement.

Flower Hero may substitute flowers, greenery, containers, ribbons, or other materials when an item is unavailable, out of season, damaged, or does not meet our quality standards. Substitutions will be made with items of comparable value while preserving the arrangement’s overall style and character whenever reasonably possible.

Delivery

Delivery times are estimates and are not guaranteed unless Flower Hero expressly agrees in writing. Customers are responsible for providing accurate delivery information and any necessary access instructions.

We are not responsible for delays or unsuccessful delivery caused by incorrect information, recipient unavailability, restricted access, severe weather, traffic, emergencies, or circumstances beyond our reasonable control. Additional charges may apply for redelivery or address corrections. When appropriate, an arrangement may be left in a reasonably safe location or with an authorized person.

Cancellations, Changes, and Refunds

Because flowers are perishable and arrangements may be custom-made, cancellations, changes, refunds, and credits are subject to Flower Hero’s posted cancellation and refund policies. Requests should be made as soon as possible. Orders already designed, sourced, prepared, or dispatched may be nonrefundable.

Quality concerns must be reported promptly with the order number, description of the concern, and photographs when reasonably requested. Flower Hero may offer a replacement, correction, store credit, or refund depending on the circumstances.

Bloom Club Subscriptions

By joining the Bloom Club, you authorize Flower Hero to charge the disclosed recurring subscription amount and applicable taxes or fees until cancellation. Pricing, billing frequency, delivery frequency, and included services will be shown when you enroll.

You may cancel by contacting Flower Hero at 832-696-2250 before your next billing date. Cancellation prevents future charges but does not automatically refund amounts already charged or deliveries already prepared. We will clearly communicate material changes to subscription pricing or benefits before they take effect.

Website Use and Intellectual Property

Website content, photographs, branding, designs, graphics, and text belong to Flower Hero or their respective owners and may not be copied, sold, modified, or used commercially without permission. You may not misuse the website, interfere with its operation, attempt unauthorized access, or submit unlawful, abusive, fraudulent, or infringing content.

Disclaimer and Limitation of Liability

To the fullest extent permitted by law, Flower Hero is not liable for indirect, incidental, special, or consequential damages arising from website use, product variations, delivery interruptions, or circumstances beyond our reasonable control. Nothing in these Terms excludes rights or remedies that cannot legally be waived.

Governing Law and Changes

These Terms are governed by Texas law. Any legal proceeding shall be brought in a court of competent jurisdiction serving Harris County, Texas, unless applicable law requires otherwise.

We may update these Terms by posting a revised version and effective date. Continued website use after an update constitutes acceptance of the revised Terms.
